Mandalay Bay caught a prior shooter, Las Vegas shooting was foreseeable.
MGM is being sued for allowing mass shooter Steven Paddock into the Mandalay Bay Hotel in Las Vegas, Nevada with dozens of weapons and thousands of rounds of ammunition. On October 1, 2017, Paddock broke out the windows of his 32nd floor suite and opened fire on the 22,000 attendees at the Route 91 Harvest Country Music Festival. MGM lawyers have fought back, denying any responsibility at all to any of the shooting victims, citing that nothing like this had ever happened before, and that the October 1 shooting was “unforeseeable.” However, in a recent Court filing in response to MGM’s Motion to Dismiss, the lawyers for several victims presented the Judge, and the public, with a prior incident just three years prior to the Paddock shooting.
Kye Dunbar was a guest at the Mandalay Bay on the 24th floor, when he was discovered by a maid to have brought into the hotel multiple weapons and ammunition. As the maids entered the room, she saw his weapons; a rifle was on a stand pointed at the Las Vegas Strip. Police were called, and Dunbar was arrested. Exposing this prior incident could prove that MGM is liable, negligent for their actions. The Dunbar incident was an eerily similar incident, except he was prevented from pulling the trigger.
Dunbar pleaded guilty in September 2015 to one count of felon in possession of a firearm and was sentenced in January 2016 to 40 months in prison. MGM had failed to mention this prior incident when they stated in Court filings that nothing like the October 1 massacre had ever happened before; their lawyers argued to the Court that they did not owe any duty to the victims to prevent the shooter’s “unanticipated and unforeseeable violence.”
Lawyers for the victims stated, “Plaintiffs are not only surprised by defendants’ strong sweeping assertion that such an event was unforeseeable, but are stunned by defendants’ assertion that nothing like the shooting had ever happened before.”
Plaintiff’s attorney Catherine Lombardo stated that she had learned of this prior incident months ago, but that the lawyers located the Federal Court Criminal filings just a few weeks ago. Lombardo also stated that the attempt to dismiss the lawsuits, without acknowledging the prior Dunbar incident, was perhaps an effort to conceal it from the Court and the public.
Lombardo, who represents many of the victims in the Route 91 Las Vegas shooting, has been speaking about the Las Vegas shooting case publicly on national news outlets such as Fox News, The Tucker Carlson Show, HLN, ABC, and on radio NRP, Sirius XM The POTUS Channel, and in print The Washington Post and People Magazine.
